Terms and Conditions of Service
General conditions governing the purchase and use of the Genomatik genomic analysis service. The ordering process implies full acceptance of these terms.

1. Parties and definitions
Provider: Media Lives S.r.l., Via Liguria 34, 20068 Peschiera Borromeo (MI) — VAT IT11422121001, owner of the Genomatik trademark.
Customer: adult individual purchasing the service through genomatik.com.
Service: genomic analysis including kit, shipping, genotyping of 612,847 SNPs, and clinical report.
Report: digital document with analysis results (predispositions, pharmacogenomics, traits, carrier status, Wellness Rating).
Kit: CE-IVD saliva collection device with prepaid shipping.
2. Acceptance of terms
Purchasing the Service implies full acceptance of these Terms, the Privacy Policy and the Informed Consent. The Customer declares having read, understood, and accepted these documents.
Genomatik reserves the right to modify these Terms. Changes apply to new orders after publication.
3. Customer requirements
The Customer declares: being 18+ years old; providing truthful data; being the sample subject or legal guardian; not purchasing for third parties without consent; not using the Service for unlawful purposes.
4. Service description
The Service includes: CE-IVD kit, prepaid shipping, genotyping (612,847 SNPs) at an ISO 15189 European laboratory, quality control (98%+ call rate), annotation on ClinVar/GWAS/CPIC, digital report.
Timeline: approximately 15 business days from sample receipt. Times are indicative.
5. Price and payment
Price shown on the website, VAT included. Single payment at order via card/Apple Pay/Google Pay through Stripe. Genomatik does not store card data.
The order is confirmed upon payment receipt.
6. Right of withdrawal
Withdrawal within 14 days of Kit receipt (EU Consumer Rights Directive). Excluded once the biological sample has been sent to the laboratory.
To withdraw: contact privacy@genomatik.com. Full refund within 14 days.
7. Unsuitable sample
If the sample doesn't meet minimum quality: automatic second attempt. If it fails: free new kit. If the third sample is unsuitable: full refund.
8. Nature of Service — Exclusion of medical service
The Service does not constitute medical care, diagnostic activity, or medical advice.
The Report is informational. Genomatik does not provide diagnoses, prognoses, or treatment plans. No therapeutic decision should be based solely on the Report.
9. Limitation of liability
Genomatik is not liable for: decisions based on the Report; direct or indirect damages from Service use; errors in public databases; scientific developments after Report generation; sample deterioration due to Customer; unauthorized access from compromised credentials; Customer's disclosure of results to third parties; force majeure.
Total liability is limited to the amount paid by the Customer.
10. Indemnification
The Customer agrees to indemnify Genomatik from claims arising from: Report use, decisions based thereon, Terms violation, false declarations, unlawful use, third-party claims.
11. Intellectual property
The Genomatik trademark, design, Report structure, algorithms and content are the property of Media Lives S.r.l. The Customer receives a personal, non-exclusive, non-transferable license for their Report. Raw data belongs to the Customer; structure and processing are Genomatik's intellectual work.
12. Service availability
Genomatik commits to continuity but does not guarantee uninterrupted availability. Suspension possible for maintenance or force majeure.
13. Force majeure
Genomatik is not liable for delays or impossibility caused by epidemics, natural disasters, wars, transport/telecommunications interruptions, technical failures, government measures.
14. Communications

15. Applicable law and jurisdiction
Italian law. For consumers: court of the Customer's place of residence in Italy. For professionals: Court of Milan.

16. Severability
If any clause is declared invalid, the remaining clauses continue in full force.
17. Assignment
The Customer may not assign rights without Genomatik's written consent. Genomatik may assign in case of corporate operations.
18. Entire agreement
These Terms, the Privacy Policy and the Informed Consent, constitute the entire agreement between the Customer and Genomatik.
